Shawnee Bend 3 Subdivision Restrictions

Shawnee Bend 3 was first platted and recorded in May, 1955 by its developer, Willmore Lake Sites, Inc.  The developer also established and recorded a declaration of restrictions at that time.  There have been several amendments to the initial declaration of Restrictions, and the Developer's Rights have been transferred multiple times.  The Shawnee Bend 3 Homeowners Association, Inc. has held the developers rights since March 10, 2012.
 
Links on the left are to copies of legal documents filed with the Camden County Recorders Office that establish the governance and restrictions for the subdivision. The following section outlines the restrictions contained in the legal documents.

 
No building, including commercial or residence, garage, incidental building, or servant living quarters shall be erected on any Lot or Lots in Subdivision, unless the plans and specifications therefor, including the location thereof, have first been submitted to Company* for its examination and approval, and the same have been approved by Company* in writing, and no such building or buildings shall be erected except strictly in accordance with such plans or specifications, including the location of any such building. Company* shall have the power to approve or reject the architectural design and/or the location of such building or buildings and the character of materials to be used thereon and therein regardless of the cost or location of the proposed building or buildings and, its decision approving or rejecting any such plans and/or specifications, and/or location thereof, shall be final and no building operations shall be commenced on any lot or lots in Subdivision until such plans, including the location of building have been so approved by Company* in writing. 
 
No trailer or mobile home,or temporary structure of any type (including tents), nor any camping, which shall include living in any vehicle, shall be permitted upon or within any lot in said subdivision Unless the same,including the location thereof, shall be approved by Willmore Lake Sites,Inc*, in writing.-
 
All Lots and Tracts and portions thereof (all collectively referred to herein as "parcels") in Shawnee Bend No. 3 shall be used solely and exclusively for single family residential purposes.
 
No parcel shall be used or maintained as a dumping ground for rubbish, trash,garbage or other waste.  Ali incinerators or other equipment for storage or disposal of solid waste materials shall be kept in a clean and sanitary condition.  Only sewage treatment plants which exclusively serve residences located in Shawnee Bend No.3, or a re-subdivision of lots thereof, may be located upon a parcel in Shawnee Bend No. 3.  Furthermore, no effluent discharge line from a sewage treatment plant located outside the boundaries of Shawnee Bend No 3 may be located upon (either above or beneath the surface of) any parcel in Shawnee Bend No.3.
 
*Note: Shawnee Bend 3 Homeowners Association, Inc. now holds the developers rights for properties in Shawnee Bend 3.  Therefore references to "Company" and "Willmore Lake Sites, Inc." in these older documents now refer to the Shawnee Bend 3 Homeowners Association, Inc.

Please remember that you may also need permits from other units of government including Camden County and the Sunrise Beach Fire Department. Ameren UE also has regulations regarding setbacks from the lake, seawall construction and dock permits.
